By completing your purchase and checking the box at checkout, you agree to the following legally binding terms and conditions governing your rental of equipment from PrimeTotes ("Company," "we," "us," or "our"), operating in Clarksville, Tennessee and surrounding Montgomery County.
You are solely responsible for all rented totes and equipment from the time of delivery until pickup is completed by PrimeTotes. All items must be returned in the same condition as delivered. Normal wear and tear is expected and accepted; however, cracks, breaks, warping, missing lids, or structural damage beyond surface scuffing will be considered damage subject to replacement charges.
PrimeTotes photographs all equipment at the time of delivery and at the time of pickup. These photos serve as the official record of equipment condition. By accepting delivery, you acknowledge and agree that delivery photos represent the condition of equipment at the start of your rental period. Pickup photos will be used to assess any damage or missing items.
If any item is returned damaged or not returned at all, the following replacement charges apply:
Any applicable charges will be applied to the card on file at checkout. PrimeTotes will notify you prior to charging and provide photo documentation supporting the assessment.
Your rental period ends on your scheduled pickup date. If items are not ready for pickup on that date, late fees will accrue as follows:
Late fees accrue daily until all equipment is returned and pickup is completed. If you need additional time, please contact us before your scheduled pickup date. Extensions are subject to availability.
Maximum late fee period is 30 days. After 30 days without return or an arranged extension, equipment will be considered non-returned and subject to the Non-Return policy outlined in Section 8.
At our sole discretion, PrimeTotes may waive late fees in the event of a documented Act of God or natural disaster (including but not limited to severe weather events, flooding, or declared states of emergency) that directly prevents the return of equipment. Waiver requests must be submitted in writing and are not guaranteed.
The following cancellation policy applies to all bookings:
To request a cancellation, contact us directly by phone or email. Cancellations are not accepted through automated systems or third-party platforms. Refunds, where applicable, will be returned to the original payment method within 5–7 business days.
PrimeTotes will make every reasonable effort to accommodate your preferred delivery and pickup windows. Delivery times are scheduled in advance and confirmed via phone or text. We operate flexibly and will work with you to find a time that fits your schedule.
In the event PrimeTotes is unable to fulfill a scheduled delivery due to circumstances within our control, you will receive a full refund or the option to reschedule at no additional charge.
PrimeTotes is not liable for delays caused by circumstances outside our control, including but not limited to severe weather, road closures, vehicle breakdowns, or other force majeure events. In such cases, we will contact you promptly to reschedule.
PrimeTotes services are limited to Clarksville, Tennessee and surrounding Montgomery County and approved surrounding areas as confirmed at the time of booking. Equipment may not be transported outside the agreed service area under any circumstances.
You agree not to relocate rented equipment outside the designated service area. If equipment is found to have been transported outside the service area, PrimeTotes reserves the right to arrange immediate retrieval at your expense and to charge applicable fees including but not limited to mileage, labor, and late fees.
If equipment is not returned within 30 days of the scheduled pickup date and no extension has been arranged, the equipment will be considered non-returned and reported as stolen property. PrimeTotes reserves the right to file a police report and pursue all available legal remedies.
You authorize PrimeTotes to charge the card on file for the full replacement cost of all unreturned items:
If items are subsequently returned after replacement charges have been applied, a refund may be issued at PrimeTotes' sole discretion, less any accrued late fees and administrative costs.
All totes must be empty, accessible, and ready for pickup at the agreed location on the scheduled pickup date. If equipment is not accessible and a return pickup attempt cannot be completed, a redelivery fee of $25 may be charged to schedule a new pickup attempt.
Rented equipment may not be used for the following:
You are solely responsible for any damage to equipment caused by improper use. PrimeTotes assumes no responsibility for damage to your belongings resulting from misuse of equipment.
You, as the renter, are solely responsible for the safe and proper use of all rented equipment throughout the rental period. This includes any use by third parties, household members, hired movers, or any other individuals who handle the equipment during your rental period. Responsibility does not transfer to any other party.
All equipment is delivered clean, sanitized, and in fully usable condition. By accepting delivery, you acknowledge that the equipment was received in satisfactory condition unless you notify PrimeTotes of any discrepancy within 2 hours of delivery.
You use all rented equipment entirely at your own risk. To the fullest extent permitted by applicable Tennessee law, PrimeTotes, its owners, employees, and agents are not liable for any injury, loss, or damage to persons or property arising from or related to your use of the rented equipment, including during loading, unloading, hauling, moving, or storage.
This limitation of liability does not apply to any liability that cannot be waived under Tennessee law.
You agree to defend, indemnify, and hold PrimeTotes, its owners, employees, and agents harmless from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorney's fees) arising out of or related to your use of the rented equipment or your breach of this Agreement.
This Agreement shall be governed by and construed in accordance with the laws of the State of Tennessee. Any disputes arising under this Agreement shall be subject to the exclusive jurisdiction of the courts of Montgomery County, Tennessee.
If any provision of this Agreement is found to be invalid or unenforceable under applicable law, the remaining provisions shall continue in full force and effect.
This Agreement constitutes the entire agreement between you and PrimeTotes regarding the rental of equipment and supersedes any prior communications, representations, or agreements, whether written or oral.
